About these terms
These terms describe the conditions for using the UX Pacific website and its publicly available content. Please read them before using the site. If you do not agree with these conditions, do not continue using it. They apply subject to applicable law and do not remove rights that cannot legally be excluded.
References to "you" mean a website visitor. References to "we", "us" and "our" mean the legal entity operating UX Pacific, which must be identified below. If you submit an enquiry on behalf of an organisation, you should have authority to share the information you provide.
Publication pending: the registered operator name, registration details where applicable and official business address must be confirmed before these terms are published. UX Pacific is the brand name used on this website.
These website terms are not a research services contract. Client projects are governed by the applicable project agreement. Research participation, any separate app, brand dashboard or campaign requires its own relevant notices and terms; this page does not establish reward, account or campaign conditions.
Using the site
You may browse the site, share links and retain reasonable extracts for personal reference or internal evaluation of our services, subject to the intellectual property conditions below. Do not imply that accessing the site gives you a client relationship, partnership or permission to represent UX Pacific.
The site provides general information about research areas, methods and potential engagements. Specific availability, locations, deliverables and timings must be confirmed for your project. Please contact us if information is unclear or appears incorrect.
Access may be interrupted by maintenance, technical issues or events outside our control. We may update or restrict parts of the site for operational or security reasons. Changes to the website do not amend obligations under an existing client agreement.
Our Privacy Policy explains the handling of personal information, and our Cookie Policy explains cookies and similar technologies. Reading these terms is not, by itself, consent to optional cookies or marketing.
Intellectual property
Website text, graphics, photographs, reports, frameworks, design and software may be protected by intellectual property rights. Those rights remain with their respective owners, including UX Pacific's operator and relevant licensors. Third-party names and trademarks remain the property of their owners.
For the limited reference and evaluation uses described above, retain source credits and do not alter content in a way that misrepresents its meaning. Where we own the necessary rights, you may quote brief extracts with clear attribution and a link to the source. This does not grant permission to reproduce third-party assets.
Commercial republication, substantial reproduction, resale, redistribution of downloads or use of our branding requires the relevant rights holder's permission, unless applicable law permits that use. Any specific licence attached to a resource governs use of that resource.
References to an organisation, product or technology do not, by themselves, indicate endorsement, sponsorship or a client relationship. Ownership and permitted use of commissioned deliverables, research recordings and pre-existing materials must be addressed in the project agreement.
Enquiries and proposals
Submitting an enquiry or having an introductory discussion does not, by itself, commission research or commit either party to a project. A project begins only when the parties have agreed the applicable engagement terms through an authorised acceptance process.
Provide accurate contact and project information, and share only material you are authorised to disclose. Do not send passwords, payment credentials, sensitive participant records or confidential third-party material through a general enquiry form. Contact us first to agree an appropriate sharing arrangement.
An enquiry alone does not establish a non-disclosure agreement. Where confidential discussions require one, arrange it before disclosure. Personal information remains subject to the Privacy Policy and applicable law; submitting an enquiry does not grant unrestricted rights to publish your materials.
Proposals specify their scope, assumptions, validity period and acceptance requirements. Before work begins, the project agreement should address deliverables, fees, taxes, payment, recruitment, locations, timings, confidentiality, data handling, ownership, cancellation and changes as relevant. This page does not impose a universal payment, refund or cancellation policy.
Where a project agreement conflicts with these website terms on a matter relating to that project, the project agreement governs, subject to applicable law. Examples and case-study outcomes are context-specific, not guarantees of future results. Research findings are evidence for decisions, not promises of sales, savings or market success.
Acceptable use
Please do not:
- Submit false information, malware, or anything unlawful through our forms.
- Attempt to gain unauthorised access to the site, its server or its database.
- Harvest personal information, bypass access restrictions or use automated requests that disrupt the site or infringe others' rights.
- Use the contact details published here to send unsolicited marketing.
Do not impersonate another person or organisation, submit material you are not entitled to share, or use the site for harassment or fraud. Ordinary lawful linking and permitted reference use are not prohibited by these restrictions.
We may restrict access where reasonably necessary to address suspected misuse, protect the site or comply with applicable legal requirements. Such action does not automatically terminate a separate client agreement.
Links to other sites
Links to third-party websites, social platforms or resources are provided for convenience or context. Their operators control their content, availability and services. Review their terms and privacy notices before interacting with them or providing information.
A link does not establish endorsement or make third-party services part of a UX Pacific engagement. Nothing in this section excludes responsibilities that applicable law places on us for our own actions.
You may link to publicly available pages in a fair and lawful way. Do not falsely suggest affiliation or present our content as your own. Permission for a link does not grant permission to reuse logos, embed protected materials or bypass restricted resources.
Disclaimers and liability
Public website content is general information, not project-specific advice or a commitment to a particular outcome. It should not replace an agreed research engagement or specialist legal, medical, engineering or other professional assessment where required.
We do not guarantee that the website will always be available, free from errors or suitable for every purpose. This does not remove obligations that applicable law requires us to meet. Please report material inaccuracies or technical problems through our contact page.
To the extent permitted by applicable law, we exclude liability for indirect or consequential business loss arising solely from use of this public website. This exclusion does not replace the liability provisions governing paid work in a project agreement.
Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence where such liability cannot be excluded, or any other liability or statutory right that cannot lawfully be excluded or limited. Mandatory consumer protections, where applicable, remain unaffected.
Governing law
Subject to mandatory applicable law, these website terms are governed by the laws of India. Courts of competent jurisdiction in Ahmedabad, Gujarat have exclusive jurisdiction over disputes relating to these website terms, except where applicable law requires otherwise.
This clause does not remove mandatory protections or rights to bring a claim in another forum where applicable law requires them. Governing law and dispute arrangements for a client project are set out in its project agreement.
If you have a concern, contact us with the relevant page, issue and supporting details so it can be reviewed. Contacting us does not prevent you from exercising a legal right or require you to miss a statutory deadline.
Changes to these terms
These terms may be updated to reflect changes to the website, its operation or applicable requirements. An approved version should display its effective or last-updated date. Changes apply prospectively and do not retrospectively change an existing project agreement.
Where applicable law requires notice or agreement to a material change, that requirement must be followed. If a provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law.
For questions about these terms, permissions, website problems or a dispute, email hello@uxpacific.com or use our contact page. Include enough detail for the issue to be identified, but do not send sensitive records through a general form.
Publication review required: confirm the legal operator details, official contact information and governing-law clause, and obtain legal approval for the markets served. This draft must not be presented as a globally certified or legally approved policy.
